1. Acceptance of Terms

By registering for an xtaya account, depositing funds, placing wagers, or otherwise engaging with the xtaya platform, you expressly agree to comply with and be bound by these Terms and Conditions, as well as all incorporated policies including our Privacy Policy, Responsible Gaming Policy, and Bonus Terms. These Terms constitute the entire agreement between you and xtaya regarding your use of our services and supersede any prior agreements or understandings.

xtaya reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice. Material changes will be communicated to registered users via email or platform notification. Your continued use of xtaya services following any modification constitutes acceptance of the revised Terms. You are responsible for regularly reviewing these Terms to remain informed of any changes. If you disagree with modified Terms, your sole remedy is to discontinue use of xtaya services and close your account.

These Terms are governed by the laws of the Republic of the Philippines and the regulatory framework established by the Philippine Amusement and Gaming Corporation (PAGCOR). All users consent to the exclusive jurisdiction of Philippine courts for any disputes arising from or relating to the use of xtaya services.

2. Eligibility and Account Registration

2.1 Age and Legal Requirements

To create an xtaya account and participate in real-money gaming, you must be at least 21 years of age, which is the minimum legal gambling age in the Philippines as established by PAGCOR regulations. By registering, you represent and warrant that you meet this age requirement. xtaya reserves the right to request proof of age at any time, and accounts failing to provide satisfactory age verification will be immediately suspended and all funds forfeited.

You further represent that you are legally permitted to participate in online gambling activities under the laws applicable to your jurisdiction of residence. You acknowledge that gambling may be restricted or prohibited in certain jurisdictions, and it is your sole responsibility to ensure compliance with local laws. xtaya does not accept players from jurisdictions where online gambling is illegal, and accessing our services through virtual private networks (VPNs) or other circumvention methods to mask your true location constitutes a material breach of these Terms.

2.2 Account Creation and Verification

Each individual may maintain only one account with xtaya. Creating multiple accounts, whether under your own name or aliases, is strictly prohibited. Detection of duplicate accounts will result in immediate closure of all related accounts, forfeiture of balances, cancellation of pending withdrawals, and permanent exclusion from xtaya services.

During registration, you must provide accurate, complete, and current information including your legal name, date of birth, residential address, contact phone number, and email address. Providing false or misleading information constitutes fraud and grounds for immediate account termination. You agree to promptly update your account information should any details change.

xtaya employs Know Your Customer (KYC) procedures in compliance with Philippine anti-money laundering regulations. You may be required to submit government-issued identification documents, proof of address, and additional verification materials at any time. Failure to complete verification within requested timeframes may result in account restrictions including suspension of withdrawal privileges until satisfactory documentation is provided.

2.3 Account Security

You must not share your login credentials with any third party, and you assume full liability for all activities occurring under your account, whether authorized by you or not. You acknowledge that internet-based transactions carry inherent risks, and xtaya shall not be liable for losses resulting from unauthorized account access unless such access resulted from our gross negligence or willful misconduct.

3. Deposits, Withdrawals, and Financial Transactions

3.1 Deposits

xtaya supports multiple deposit methods including GCash, Maya, bank transfers, and other payment channels displayed on our platform. Minimum and maximum deposit amounts vary by payment method and are clearly indicated during the deposit process. Deposited funds are credited to your account balance and become available for wagering upon successful payment processing.

You represent and warrant that all funds deposited to your xtaya account originate from legitimate sources and belong to you personally. Deposits from third-party accounts, stolen credit cards, or proceeds of illegal activity are strictly prohibited. xtaya reserves the right to investigate suspicious deposits and may freeze accounts, confiscate funds, and report findings to appropriate authorities when fraudulent activity is suspected.

All deposits are final and non-refundable except in cases of proven platform error. Accidentally deposited funds cannot be withdrawn until wagering requirements, if applicable, have been satisfied. xtaya does not charge deposit fees, though your payment provider may impose transaction charges beyond our control.

3.2 Withdrawals

Withdrawal requests are processed to the same payment method used for deposit, subject to verification and security checks. xtaya processes most withdrawal requests within 24-48 hours, though processing times may vary depending on payment method and verification requirements. Minimum withdrawal amounts apply and are specified on our platform.

Before processing withdrawals, xtaya may require completion of identity verification, source of funds documentation, and satisfaction of any applicable wagering requirements attached to bonuses. Withdrawals to unverified accounts may be declined or delayed until verification is completed. First-time withdrawals typically undergo enhanced review as an anti-fraud measure.

xtaya reserves the right to refuse withdrawal requests that violate these Terms, involve suspected fraud or money laundering, or fail to satisfy bonus wagering requirements. In cases of suspected fraudulent activity, accounts may be frozen while investigations proceed, and withdrawals will not be processed until matters are resolved.

3.3 Account Balance and Currency

All transactions on xtaya are conducted in Philippine Pesos (PHP). Your account balance reflects funds available for wagering and is updated in real-time as you place bets, win prizes, and conduct financial transactions. Account balances do not accrue interest and cannot be transferred between user accounts.

Unclaimed account balances may be subject to dormancy fees after extended periods of inactivity as specified in our fee schedule. xtaya will make reasonable efforts to contact account holders before applying inactivity charges. Accounts with balances below the minimum threshold may be closed after one year of inactivity, with remaining funds forfeited in accordance with Philippine unclaimed property laws.

4. Gaming Rules and Conduct

4.1 Game Rules and Results

All casino games, slot machines, live dealer games, bingo, and sports betting markets offered by xtaya are governed by specific rules detailed in their respective game descriptions and help sections. You are responsible for understanding game rules before placing wagers. All game outcomes are determined by certified random number generators (RNGs) or live dealer results, as applicable, and are final and binding.

The following activities are strictly prohibited and constitute material breaches of these Terms, resulting in immediate account suspension and forfeiture of funds:

• Collusion and Cheating: Collaborating with other players to gain unfair advantages, using automated betting software or bots, exploiting software bugs or errors, or manipulating game outcomes through technical means.
• Money Laundering: Depositing funds without placing substantial wagers, requesting withdrawals shortly after deposits without meaningful gaming activity, or using xtaya as a payment transfer service rather than for gaming entertainment.
• Fraudulent Activity: Using stolen credit cards or payment accounts, providing false identification documents, impersonating another individual, or conducting transactions with the intent to defraud xtaya or other users.
• Unauthorized Access: Attempting to access other users' accounts, circumventing security measures, reverse engineering platform software, or exploiting vulnerabilities in the xtaya system.

Detection of prohibited activities may result in account closure, forfeiture of all balances including winnings, reversal of completed transactions, and referral to law enforcement authorities. xtaya may share information regarding fraudulent accounts with other gaming operators and industry fraud prevention services.

4.3 Responsible Gaming

xtaya is committed to promoting responsible gaming and preventing gambling-related harm. We provide tools including deposit limits, loss limits, session time limits, and self-exclusion options to help players maintain control over their gaming activities. All users are encouraged to set personal limits and seek professional assistance if gambling becomes problematic.

5. Bonuses and Promotions

5.1 Bonus Terms

Wagering requirements specify the amount you must wager before bonus funds and associated winnings become withdrawable. For example, a deposit bonus with 30x wagering requirements means you must place total wagers equal to thirty times the bonus amount before requesting a withdrawal. xtaya reserves the right to modify, suspend, or terminate any promotion at any time without prior notice. 5.2 Bonus Restrictions

Only one bonus may be active per account at any given time unless explicitly stated otherwise. Bonuses cannot be combined or stacked. Attempting to circumvent bonus restrictions through multiple accounts or coordination with other users results in immediate forfeiture of bonuses and potential account closure.

Maximum withdrawal limits may apply to winnings derived from bonuses, regardless of actual balance. These limits are specified in each promotion's terms and conditions. Winnings exceeding maximum bonus withdrawal amounts will be removed from your account when the withdrawal is processed.

6. Intellectual Property

All content on the xtaya platform including but not limited to text, graphics, logos, images, software, game content, and trademarks are the exclusive property of xtaya or our licensed content providers and are protected by Philippine and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use xtaya services for personal entertainment purposes only.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the xtaya platform except as explicitly permitted. Unauthorized use of xtaya intellectual property may violate copyright, trademark, and other laws and will result in immediate account termination and potential legal action.

7. Limitation of Liability

To the maximum extent permitted by Philippine law, xtaya and its officers, directors, employees, affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use xtaya services, including but not limited to loss of profits, data, or other intangible losses, even if advised of the possibility of such damages.

xtaya provides services on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee uninterrupted access to our platform, error-free operation, or that defects will be corrected. You acknowledge that internet-based services may be subject to outages, technical difficulties, and security threats beyond our control.

Our total liability to you for any claims arising from your use of xtaya services is limited to the amount of funds in your account balance at the time the claim arose, not to exceed the total amount deposited by you in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

8. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or your use of xtaya services, you agree to first contact our customer support team to seek informal resolution. Most disputes can be resolved satisfactorily through direct communication.

If informal resolution fails, disputes shall be resolved through binding arbitration conducted in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI) or such other arbitration body as mutually agreed. Arbitration shall be conducted in English in Metro Manila, Philippines, before a single arbitrator. The arbitrator's decision shall be final and binding on both parties.

Notwithstanding the foregoing arbitration provision, xtaya retains the right to seek injunctive relief in Philippine courts for violations of intellectual property rights, fraud, or other matters requiring immediate equitable relief. Both parties consent to the exclusive jurisdiction of courts in Metro Manila, Philippines for such proceedings.

9. Account Closure and Suspension

You may close your xtaya account at any time by contacting customer support. Upon closure, you must withdraw all remaining balances, and any unused bonus funds will be forfeited. Closed accounts cannot be reopened, and new account creation by the same individual is prohibited.

xtaya reserves the right to suspend or permanently close your account at any time for violation of these Terms, fraudulent activity, or at our sole discretion. In such cases, we will endeavor to refund your deposited funds after deducting any amounts owed to xtaya, though we reserve the right to forfeit balances in cases of fraud or Terms violations. Decisions regarding account closures are final and not subject to appeal.

10. General Provisions

These Terms constitute the entire agreement between you and xtaya regarding use of our services and supersede any prior agreements or communications. If any provision of these Terms is found invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

xtaya's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. These Terms and all rights and obligations hereunder are personal to you and may not be assigned or transferred without xtaya's prior written consent.

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Metro Manila, Philippines.
